A - The following are exempt unless any such person or entity has a separate company, corporation, or division that is in the business of supplying durable medical equipment to consumers and submits a claim for reimbursement by a third party: (1) Pharmacies and pharmacists; (2) Hospitals; (3) Ambulatory surgical centers; (4) Health care facilities owned or operated by the state or federal government; (5) Skilled nursing facilities; (6) Assisted living facilities; (7) Health care practitioners who: (A) Provide durable medical equipment within the scope of practice of the health care practitioner's profession; and (B) Are licensed in this state to practice the health care practitioner's profession. (Added: 02/01/2018)

B - Licensed opticians prepare and dispense lenses, spectacles, eyeglasses, contact lenses and optical devices as authorized by a written prescription from an optometrist or physician skilled in diseases of the eye. A licensed Optometrist or Ophthalmologist may also dispense these items.

C - An orthotist or prosthetist license is not required for physicians, physical therapists, occupational therapists, etc. as long as the items that are being provided are in relation to their profession.
