A - The HME license is needed if the pharmacy is engaged in the sale or rental of home medical equipment and services. (i.e. providing technologically sophisticated devices or other similar articles bearing label that states “Caution: federal law requires dispensing by or on the order of a physician.” Example: oxygen, ventilators, Tens units, custom fitted or motorized wheelchairs, pumps, beds, etc.)

C - The following home medical equipment services providers are exempt from licensure unless those practices, services, or activities include providing home medical equipment and services through a separate legal entity: (1) a person licensed or registered in this State by any other law engaging in the profession or occupation for which he or she is licensed or registered; (2) a home medical services provider entity that is accredited under home care standards by a recognized accrediting body; (3) hospitals, excluding hospital-owned and hospital-related providers of home medical equipment and services; (4) health care practitioners who lawfully prescribe, order, or use home medical equipment and services to treat their own patients (exemption is lost if dispensing equipment prescribed by other providers), including but not limited to physicians, nurses, physical therapists, respiratory therapists, occupational therapists, speech-language pathologists, optometrists, chiropractors, and podiatric physicians; (5) nursing homes; and (6) dentists.

D - If supplying orthotic, prosthetic, or pedorthic items, the items must be dispensed under the supervision of a licensed Orthotist, Prosthetist, or Pedorthist. A Pedorthist License is acceptable as long as the orthosis is below the ankle (and foot). A physician, physical therapist, occupational therapist, or advanced practice nurse are also acceptable for supplying orthotic, prosthetic or pedorthic items.

E - There is no state license for Ocularist, only Board Certified Ocularist (National Examining Board of Ocularists (NEBO)). The website: http://www.neboboard.org/ has information on this certification.

H - Conventional Contact and Prosthetic Cataract lenses may be sold or dispensed in a retail optical dispensary or other permanently established place of business with an optical department only when authorized by an optometrist licensed to prescribe, fit or furnish these lenses. Illinois licensed pharmacists or physicians may also dispense these items.

I - Exclusion applies to, any person licensed under the Medical Practice Act of 1987 to practice medicine in all of its branches shall be authorized to purchase legend drugs requiring an order of a person authorized to prescribe drugs, and to dispense such legend drugs in the regular course of practicing medicine. The dispensing of such legend drugs shall be the personal act of the person licensed under this Act and may not be delegated to any other person not licensed under this Act or the Pharmacy Practice Act unless such delegated dispensing functions are under the direct supervision of the physician authorized to dispense legend drugs. Nothing in this Act shall be construed to authorize a chiropractic physician to prescribe drugs.
