B - For out of state suppliers: A Non-Resident Pharmacy Permit authorizes facilities outside of this State whose primary business is filling mail order or internet prescriptions to engage in the sale, distribution, or dispensing of legend drugs or devices in this State. A Non-Resident Medical Gas & Legend Device Permit authorizes a facility to dispense to a patient or patient’s agent, medical gases and legend devices to end users in SC. Edited 11/07/2016

C - The Opticians and Contact Lens Dispenser licenses do not apply to physicians licensed in this State for the practice of medicine or osteopathy and optometrists licensed under the laws of this State to practice optometry.

D - The Medical Gases/Legend Devices Permit is required for in-state and out-of-state suppliers that dispense medical gases and prescription (Rx-only) devices per FDA determination. The following practitioners and pharmacies are exempt from needing this permit: Physicians, Dentists, Optometrists, and Podiatrists who possess or administer devices in the regular course of their professional practice or dispense devices that are the lawful property of the practitioner. SC licensed Chiropractors may dispense Transcutaneous Electrical Nerve Stimulation (TENS) units without needing the Medical Gases/Legend Devices permit.

Z - As of 2008, Cochlear Implants are no longer considered DME, and they are now paid through Part B
