D: The licensure requirements of this chapter do not apply to the following entities or practitioners: (1) Home health agencies certified by the State of Alabama to participate in the Medicare and Medicaid programs. (2) Hospital based home medical equipment services, whether or not the services are provided through a separate corporation or other business entity. (3) Health care practitioners legally eligible to order or prescribe home medical equipment, or who use home medical equipment to treat patients in locations other than the patient's residence, including, but not limited to, physicians, nurses, physical therapists, respiratory therapists, speech therapists, occupational therapists, optometrists, chiropractors, and podiatrists, except for those practitioners, other than a licensed physician practicing medicine, who provide home medical equipment services in a patient's residence. (4) Manufacturers and wholesale distributors, when not selling directly to the patient. (5) Retail community pharmacies, including providers of home infusion therapy services. (6) Hospice programs, except programs which provide home medical equipment services, including delivery to a patient's residence. (7) Skilled nursing facilities, except facilities which provide home medical equipment services, including delivery to a patient's residence. (8) Governmental agencies, including fire districts which provide emergency medical services and contractors to governmental agencies whose business deals only with the contracted agency. (9) Mail order companies, as defined by rule of the board (See note H).

IL Home Medical Equipment and Services Provider License Yes Y Yes C: The following home medical equipment services providers are exempt from licensure unless those practices, services, or activities include providing home medical equipment and services through a separate legal entity: (1) a person licensed or registered in this State by any other law engaging in the profession or occupation for which he or she is licensed or registered; (2) a home medical services provider entity that is accredited under home care standards by a recognized accrediting body; (3) hospitals, excluding hospital-owned and hospital-related providers of home medical equipment and services; (4) health care practitioners who lawfully prescribe, order, or use home medical equipment and services to treat their own patients (exemption is lost if dispensing equipment prescribed by other providers), including but not limited to physicians, nurses, physical therapists, respiratory therapists, occupational therapists, speech-language pathologists, optometrists, chiropractors, and podiatric physicians; (5) nursing homes; and (6) dentists.
IN Home Medical Equipment Service Provider Yes Y No B: The Home Medical Equipment Service Provider license does not apply to the following: (1) A hospital licensed under IC 16-21-2 that: (A) provides home medical equipment services only as an integral part of patient care; and (B) does not provide home medical equipment services through a separate business entity; (2) A practitioner (i.e. Physician, Dentist, Podiatrist, Optometrist) who does not sell, lease, or rent home medical equipment; (3) A provider that: (A) provides home medical equipment services within the scope of the licensed provider's professional practice; (B) is otherwise licensed by the state; and (C) receives annual continuing education that is documented by the provider or the licensing entity; (4) A pharmacist licensed in Indiana or a pharmacy that holds a permit issued under IC 25-26. If an out of state supplier, the supplier is not required to have a physical representative in the state. However, the supplier must be available twenty-four (24) hours a day to provide home medical equipment emergency maintenance per IC 25-26-21-6 regulation.
I: A Sterilization or Disinfection Permit is only required of suppliers who are using or selling secondhand articles of bedding or filling materials. The permit is not needed if the supplier holds a current bedding permit from another state that allows for the handling of secondhand items. These suppliers are required to contact and send in a copy of their out of state bedding permit to the Indiana Division of Weights and Measures, which will allow them to keep a copy of the out-of-state permit on file.

C: Durable medical equipment" means equipment that: (1) Provides therapeutic benefits or enables an individual to perform certain tasks that the individual is unable to otherwise undertake due to certain medical conditions or illnesses; (2) is primarily and customarily used to serve a medical purpose; (3) generally is not useful to a person in the absence of an illness or injury; (4) can withstand repeated use; (5) is appropriate for use in the home, long-term care facility or medical care facility, but may be transported to other locations to allow the individual to complete instrumental activities of daily living that are more complex tasks required for independent living; and (6) may include devices and medical supplies or other similar equipment determined by the board in rules and regulations adopted by the board.
KY Home Medical Equipment License Yes Y No C: Exemptions to the HME license include: Unless home medical equipment and services are provided through a separate legal entity, nothing in KRS 315.510 to 315.524 or any administrative regulations promulgated thereunder shall be construed as preventing or restricting the practices, services, or activities of the following: (a) A person licensed or registered in this state under any other law who is engaging in the profession or occupation for which he or she is licensed or registered; (b) Health care practitioners who lawfully prescribe or order home medical equipment and services, or who use home medical equipment and services to treat their patients; (d) Hospitals that provide home medical equipment and services only as an integral part of patient care; (f) Pharmacies that are engaged in the sale, lease, or rental of home medical equipment and services [Pharmacies that provide home medical equipment to patients as a separate business entity from the pharmacy must have home medical equipment license]; [pharmacies located outside of KY must hold a KY out-of-state pharmacy permit] (g) An employee of a person licensed under KRS 315.510 to 315.524; (j) Government agencies, including fire districts which provide emergency medical services. (k) An out-of-state manufacturer or provider of a sole source type of equipment that is not available through a provider in Kentucky or one of its reciprocal states.
LA Durable Medical Equipment Permit (DME Permit) Yes Y No D: Effective May 02, 2012, the DME Permit will authorize the procurement, possession and provision of legend devices, medical gas and DME to Louisiana citizens. It specifically excludes authority for the procurement, possession, or provision of prescription drugs. It is required for all such suppliers regardless of their location. MD Residential Service Agency License D: The “Residential Service Agency” (RSA) license is required regardless of supplier type or pharmacy (in-state and out-of-state) if delivering DME, Orthotics, or Prosthetics to individuals in a private residence. This license is not needed if the business engages in mail order only via a common mail carrier. Additionally, the RSA license requirement does not apply to Maryland licensed home health agencies, hospitals, or individuals practicing in a health occupation for which the individual is authorized to practice under Health Occupations Article, Annotated Code of Maryland including Physicians, Podiatrists, Optometrists, Chiropractors, and Dentists. (8LMM280126) Y Yes C: “Residential service agency” means: (i) Any individual, partnership, firm, association, corporation, or other business entity of any kind that is engaged in a nongovernmental business of employing or contracting with individuals to provide at least one home health care service for compensation to an unrelated sick or disabled individual in the residence of that individual; or (ii) An agency that employs or contracts with individuals directly for hire as home health care providers. E: “Home medical equipment services” means the delivery, installation, maintenance, or replacement of, or instruction in the use of, medical equipment used by a sick or disabled individual to allow the individual to be maintained in a noninstitutional environment.(9-1) “Medical equipment” means technologically sophisticated medical devices including but not limited to: (a) Oxygen and oxygen delivery systems; (b) Ventilators; (c) Respiratory disease management devices; (d) Electronic and computer-driven wheelchairs and seating systems; (e) Apnea monitors; (f) Transcutaneous electrical nerve stimulator (T.E.N.S.) units; (g) Low air loss cutaneous pressure management devices; (h) Sequential compression devices; (i) Neonatal home phototherapy devices; (j) Feeding pumps; and (k) Electrically powered hospital beds.

NC Device and Medical Equipment Dispensing Permit Yes Y No B: Each place, whether located in this State or out-of-state, that delivers medical equipment to the user of the equipment in this State shall register annually with the Board and obtain a medical equipment permit. A business that has a current pharmacy permit or a current device permit does not have to register and obtain a medical equipment permit. The address on the permit must match the location. “Medical equipment" means any of the following items that are intended for use by the consumer in the consumer's place of residence: (1) A device; (2) Ambulation assistance equipment; (3) Mobility equipment. Additionally, suppliers providing custom orthotics or prosthetics must be approved by the Board and submit evidence that the supplier has employed or contracted with an individual who holds a national certification through the American Board of Certification (ABC) or the Board of Certification (BOC) to provide these items. NY Retailer/Wholesaler of Used Bedding Registration Yes Y Yes B: A Retailer/Wholesaler of Used Bedding Registration is required for suppliers selling, renting, repairing, or rebuilding any used mattress or box spring, which can be used for sleeping or reclining. Manufacturers or wholesale distributors that do not sell or rent Durable Medical Equipment directly to consumers; 10. Suppliers of insulin infusion pumps and related supplies or services; or 11. Suppliers of medical devices approved by the U.S. Food and Drug Administration that are used in the treatment of cancerous tumors. Manufacturers or wholesale distributors that do not sell or rent Durable Medical Equipment directly to consumers; 10. Suppliers of insulin infusion pumps and related supplies or services; or 11. Suppliers of medical devices approved by the U.S. Food and Drug Administration that are used in the treatment of cancerous tumors.
H: Per Title 59, Section 375.4 (A)(1), the applicant Maintains a physical office or place of business within this state; (A)(1)(b) For a Medicare or Medicaid enrolled out-of-state supplier, maintains a physical office or place of business within one hundred (100) miles of a resident of this state being served by the supplier; (B)(1), the Board may issue a license to a Medicare or Medicaid enrolled out of state supplier who has at least one accredited facility within one hundred miles of the patient of this state being served by the supplier.
