A - The Device Distributor license is not needed if the supplier holds a Device Manufacturer License. The Device Distributor and Manufacturer licenses do not apply to Physicians, Podiatrists, Optometrists, Dentists, Pharmacies, or licensed Hospitals if they only obtain the device for lawful administration to a patient or only provide the device directly to a patient. In addition, the Device Distributor and Manufacturer licenses do not apply to providers who only deliver non-FDA RX only (over-the-counter) devices directly to a patient. The provider may hold the Multi Products license that shows each covered commodity on the license. (i.e. Compressed Medical Gases, Nonprescription Drugs, Food, Devices) (Effective: 09/01/1989; Added: 09/2011; Rev.2: 03/20/2014)

B - If located in-state and supplying oxygen, a “Distributor of Prescription Drugs License ”, or “Multiple Products (Wholesale Distributor of Compressed Medical Gases, Devices) License” or “Prescription Drug Manufacturer License” with expiration date is required. Suppliers that transfill tanks need the Prescription Drug Manufacturer License. If a supplier has multiple locations, but has a warehouse where the oxygen is stored, the location where the oxygen is stored is required to have the Wholesale Distributor of Compressed Medical Gases license. If any oxygen is stored at any other location, that location will also require a license. (Updated 01/06/2020)

C - Custom-made or custom-fitted items must be provided by a “Licensed Prosthetist” or “Licensed Orthotist/Prosthetist” in a State licensed “Accredited Facility. The Texas O&P statute exempts certain license holders: (1) a podiatrist practicing under Chapter 202; (2) a chiropractor practicing under Chapter 201; (3) an occupational therapist practicing under Chapter 454; or (4) a physical therapist practicing under Chapter 453. A Board for Certification (BOC) Pedorthist’s scope of practice is limited to below the ankle. A pharmacist licensed by the Texas State Board of Pharmacy or a person who is working under the direct supervision of a pharmacist may practice orthotics.

E - The Texas O&P Board issued a statement that any individual who custom fits a diabetic or other shoe through means of moldable inserts or other methods, regardless of where the final shoe is manufactured, is practicing orthotics per Sections 605.002 (3), (4), (12), and (14).and must either be licensed under the Texas Orthotics and Prosthetics Act or exempt. Exemptions include only physical therapists, occupational therapists, chiropractors, podiatrists, pharmacists, and certified pedorthists who provide devices that affect the anatomical ankle and below. With the exception of certified pedorthists, the listed professionals may operate and provide orthotic devices under the auspices of their own Acts as defined in state law.
